Conditions for participation and other information

1 Contracting Parties

These terms and conditions of participation apply between the organizers of the Bergwandercamp

Manno Peters, Stefan Heller, Florian Höfer (hereinafter referred to as "organizer")

and

the participating persons (hereinafter referred to as "participants") who register bindingly to participate in the private group tour described below.

2 Character of the event

(1) The event is a purely private, non-commercial leisure event in the circle of friends and acquaintances and in the extended social environment.

(2) The organizer acts on a voluntary basis and not as a tour operator within the meaning of §§ 651a et seq. of the German Civil Code, not as an entrepreneur (§ 14 of the German Civil Code) and not as an intermediary for remuneration.

(3) No package travel contract is expressly established. Each participant organizes his or her participation on his or her own responsibility.

(4) The event is a closed group. Participation is only possible if the participants are or become members of this group and accept the terms and conditions of participation. Each group member is listed on an internal address list with the contact details necessary for the organization and implementation of the trip.

(5) From a legal point of view, the participants represent a partnership under civil law (§§ 705 et seq. BGB).

3 Scope of service

(1) The organizer will only undertake the following activities:

  • Coordination of collective rental of accommodation, van and purchase of food, cleaning supplies, etc.
  • Collection and forwarding of cost shares.
  • Sharing organizational information

(2) There is no entitlement to specific services, quality standards or care.

(3) Arrival and departure, leisure activities as well as individual insurances are the responsibility of the participants.

4 Sharing of costs and expenses

(1) The total costs (accommodation rent, ancillary costs, final cleaning, communal catering, van rental and operating costs) will be apportioned proportionately to all participants. The organizer charges the fees exclusively to cover costs.

(2) The obligation to pay arises from § 670 BGB (reimbursement of expenses) in conjunction with an unnamed order (§§ 662 et seq. BGB analogously).

(3) The organizer does not make a profit. Any shortfalls will be claimed on a pro rata basis, surpluses will be reimbursed on a pro rata basis or planned jointly.

(4) The participation fee will be paid after the participant has received an e-mail from the organizer with the request for payment. With payment, the participant declares his participation bindingly.

5 Withdrawal, no-show, substitute participant

(1) In the event of withdrawal or no-show, the obligation to bear the costs remains in place (§ 326 para. 2 sentence 1 BGB analogously), unless the costs are covered by substitute participants from the waiting list.

6 Liability of the organiser

(1) The organiser is only liable for damages that are based on intentional or grossly negligent behavior (§ 276 para. 1 BGB).

(2) Liability for simple negligence is excluded if there is no injury to life, limb or health (§ 309 No. 7 BGB analogously).

(3) There is no liability for:

  • Accidents, personal injury, or property damage
  • Loss or theft of personal belongings
  • Actions of other participants
  • Services provided by third parties (e.g. accommodation operators)

7 Personal responsibility of the participants

(1) Each participant participates in the hikes and other activities at his or her own risk (§ 254 BGB – contributory negligence). The journey (e.g. in carpools) is also done on your own initiative.

(2) Each participant is obliged to comply with applicable house rules, safety regulations and legal regulations.

(3) The conclusion of suitable insurance (e.g. international health insurance, liability, accident, travel cancellation insurance) is the responsibility of the participant.

8 Domiciliary rights and exclusion

(1) The organizer exercises domiciliary rights during the event within the framework of the agreement with the accommodation operator.

(2) Participants can be excluded in the event of significant breaches of duty. In this case, there is no entitlement to reimbursement of costs (§ 314 BGB analogously).

9 Data protection

(1) Personal data will be processed exclusively for the organization of the event.

(2) The legal basis is Art. 6 (1) (b) GDPR.

(3) It will only be passed on to third parties if this is necessary for the implementation.

10 Severability clause

Should individually provisions of this agreement be or become invalid in whole or in part, the validity of the remaining provisions shall remain unaffected (Section 306 of the German Civil Code).

11 Place of jurisdiction and applicable law

(1) German law applies exclusively.

(2) The place of jurisdiction is – as far as legally permissible – the place of residence of the organizer (§§ 12, 38 ZPO)
